Henry County Courthouse and Government Records

Researchers often overlook the importance of Henry County court, probate, and land records as a source of genealogy and family history information. Buried away in Tennessee courthouses and archives everywhere are the dreams and frustrations of many Tennessee citizens. The chances are great that your ancestors have left a detailed record of at least some aspects of their lives in the Henry County court records.

Please call the clerk’s department to confirm hours, mailing address, fees and other specifics before visiting or requesting information because of sometimes changing contact information. Even if your ancestor is not mentioned in a Court case, consider all of the other procedures which could have lead to him or her appearing in court records.

The following indicates what vital, land, probate, and court records are in Henry county or in the Tennessee State Library & Archives.  The dates indicated below are the first known records for each county. Rather than go to the courthouse, you might want to do all your research work at the library. All available court records have been microfilmed and are available at the Rhea Public Library. In addition to court records, you will also find funeral home records, church records, all the Henry County census, Microfilmed Henry County newspaper, and WPA records. There is also a large collection of genealogy books in the special genealogy room.

  • Henry County Clerkmaintains Marriage & Divorce records. It also has jurisdiction over probate cases. Wills, administrations, and all other records pertaining to probate are recorded in the respective county clerk’s office. If the will or administration was contested, the records of these actions may be filed in the circuit court or chancery court.

  • Henry County Register of Deedshas land records beginning with county organization, land records are available from the register of deeds at the Sevier county courthouse. Land and property records include transfer of real estate or personal property, mortgages, leases, surveys, and entries.

  • Henry County Clerk of Circuit Courthas jurisdiction over property disputes, and circuit courts oversee criminal cases, divorces, and adoptions. Early courts included courts of common pleas and quarter sessions.

  • Henry County Property Assessoris responsible for the evaluation of all real property, the cadastral mapping of the county, valuation of all business personal property and maintaining ownership records. The property assessor prepares the tax rolls for the trustee and all the municipalities. Tax lists can be used to locate families, document historic properties and study community history. Early tax lists generally include all white males over 21 and indicate whether they owned land or slaves.

  • Tennessee Department of Health (VDH) Office of Vital Records has copies for copies of birth certificates, marriage licenses and divorce decrees. There is a fee for each copy requested. Please refer to the information to the Statewide Vital Records in Tennesseefor current fees and application process.
